STRENGTHEN PROGRAM APPLICATION
GODSPEED magazine LLC operates www.godspeedmag.com (the "website"), the magazine, and its associated services. These terms of service govern your use of, and or your participation in, the Strengthen program and its associated benefits. Please read these terms of service carefully. If you do not wish to be bound by these terms of service, you should not apply to become a Ministry Partner.
Participating in the Strengthen program created by GODSPEED magazine LLC, hereinafter referred to as GSM, allows legitimate ministries, churches, and Non Profit Organizations (NPOs), hereinafter referred to as Ministry Partners, an opportunity to generate funding and promotion for good works unto Jesus Christ. Any Ministry Partner who applies to join GSM’s Strengthen program, does so by accepting the terms as stated in this document.
These terms of service may change or be updated from time to time. It remains your responsibility to access and check these terms of service wherever you access the GSM website. The latest version of the terms of service will govern any future usage by you of the Strengthen program and its associated services.
GSM’s Strengthen program operates in support of our Ministry Partners in the United States of America. The Strengthen program’s system does provide an opportunity for our Ministry Partners to generate repeated donations and promotion when the proper conditions are met but becoming a Ministry Partner in GSM’s Strengthen program has no other related rights or privileges within GSM or it’s related companies, partners, successors, assigns, affiliates, etc.
Here are the key points:
Unique Subscription Links- GSM publishes a monthly digital issue with recurring (monthly) subscription fees which are set by GSM. When a NPO, ministry, church, Kingdom movement, etc applies and is approved to become a GSM Ministry Partner within GSM’s Strengthen program, a unique subscription page is created on GSM’s website exclusively for that Ministry Partner and the unique link to that page can be shared with all the Ministry Partner’s audiences by email, social media, websites, etc.
Payments and Percentages
Authentic readers who subscribe to GSM by clicking on a Ministry Partners’ link, will cause a donation for half (50%) of the GSM subscription fees to be paid to that unique Ministry Partner for as long as those subscribers are contiguously subscribed to GSM, unless the Ministry Partner violates the terms and conditions stated in this agreement. Approved payments will be distributed once a month by direct deposit to each Ministry Partner.
Ministry Partners Approval
All organizations that apply to become GSM Ministry Partners within the Strengthen program must complete GSM’s application and accept the terms and conditions in addition to being validated against US government records to confirm their legal NPO or other status. GSM does not make any guarantee or representation of their other Ministry Partner’s current legal status. GSM retains the right to approve any Ministry Partner including those who are startups, unofficial movements, business-as-mission, etc as long as they meet GSM’s additional criteria. Ministry Partners agree not to attempt, or be involved in any, falsification of subscribers. If it is proven that the Ministry Partner was involved in subscriber falsification in any way, legal consequences, including termination from the Strengthen program, will be pursued to the fullest extent provided by the laws of the State of California, with jurisdiction in San Diego county.
Strengthen Program Minimums
GSM’s Strengthen program has specific internal personnel, HTML coding, payment processing, accounting, and other related costs. Ministry Partners pay nothing to enroll in GSM’s Strengthen program but will ideally average at least 150 paid subscribers per month in order to continue being eligible to receive funding from GSM.
Strengthen Program Account Manager
When Ministry Partners reach a minimum of 1,000 paid subscribers; GSM will assign an account manager to them and a monthly subscriber report will be provided.
Gaining Promotion
The first twelve ministries to reach 1,500 paid monthly subscribers will have a full-page ad in GODSPEED magazine donated to them for as long as they retain at least 1,500 paid subscribers per month. After the first twelve ministries reach this goal, the requirement for a full-page ad donation will be raised to 3,520 paid monthly subscribers. If any of the first twelve ministries drop below 1,500 paid monthly subscribers, their full-page ad will be given to the next Ministry Partner in line.
Release of Liability
GSM provides no performance guarantees and assumes no liability for any disruption, technical, cyber attack, or payment failures as a result of GSM’s online systems going down for any length of time but will always work to recover the systems, information, and payments to the best of our ability as soon as possible.
Ministry Partner Endorsements
GSM is not in the business of personally endorsing our Ministry Partners. Our goal is to help fund and advertise the Kingdom work being done by our brothers and sisters in Christ by shepherding those gifts and strengths which God has given us.
GSM Content
We reserve the right in our sole discretion and without notice to suspend, cancel, or delete any Ministry Partner whose material we deem illegal, falsified, offensive, obscene, racist, defamatory, misleading or deceptive. All email marketing, social media posts, ad creative, etc must be Christian friendly and content must be copyright-protected. GSM will comply with any court orders, subpoenas, writs, injunctions, or other applicable laws and regulations which may result in a suspension of or cancelling and deleting any fundraiser.
Taxes
The donations made by GSM should be included in the Ministry Partner’s gross income and may be subject to reporting by the Ministry Partner to the IRS. If required, reporting is the sole responsibility of the Ministry Partner to undertake and GSM disclaims all liability for failure to report. In the event a dispute arises regarding IRS reporting, GSM shall be indemnified by the Ministry Partner.
Limitation of Liability
While GSM does its best to ensure the optimal performance of GSM’s website and all related softwares on which GSM’s Strengthen program operates, you agree that you use the Strengthen program and rely on the materials and systems provided at your own risk.
GSM’s website, and all related softwares and assets of the Strengthen program, are provided “as is” and, to the fullest extent permitted by law, are provided without warranties of any kind either express or implied. This means, without limitation, that GSM DOES NOT WARRANT that the Strengthen program and related systems are fit for any particular purpose; that the functions offered in GSM’s Strengthen program will be uninterrupted; that defects will always be corrected; that GSM’s systems and website will always be free of viruses and other harmful components or that GSM’s Strengthen program assets will always be accurate, error free or reliable.
Ministry partner acknowledges that GSM and third party providers, their parents and affiliates together with their respective employees, agents, directors, officers and shareholders, ARE NOT LIABLE for any delays, inaccuracies, failures, errors, omissions, interruptions, deletions, defects, viruses, communication line failures or for the theft, destruction, damage or unauthorized access to your computer system or network.
Ministry partner acknowledges that GSM is not liable for any defamatory, offensive or illegal conduct or material found in connection with this GSM’s website, including such conduct or material transmitted by any means by any other persons.
Ministry Partner acknowledges that GSM and third party content providers are not liable for any damages, including, without limitation, direct, incidental, special, consequential or punitive damages, in connection with or arising from your use or from your inability to use the Strengthen program.
Indemnity
Ministry partner agrees to defend, indemnify and hold harmless GSM, its parents and affiliates together with their respective employees, agents, directors, officers and shareholders, from and against all the liabilities, claims, damages and expenses (including reasonable attorney’s fees and costs) arising out of your use of the Strengthen program and related systems; your failure to use the Strengthen program; your breach or alleged breach of these terms and conditions or your breach or alleged breach of the copyright, trademark, proprietary or other rights of third parties.
Severability
If any provision of these terms and conditions are held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of the terms and conditions shall remain operative and binding on the parties.
Entire Agreement
These terms and conditions supersede any and all other prior understandings and agreements, either oral or in writing, between the parties with respect to the subject matter hereof and constitute the sole and only agreements between the parties with respect to the said subject matter. All prior negotiations and agreements between the parties with respect to the subject matter hereof are merged into these terms and conditions. Each party to these terms and conditions acknowledges that no representations, inducements, promises, or agreements, orally or otherwise, have been made by any party or by anyone acting on behalf of any party, which are not embodied in this agreement and that any agreement, statement or promise that is not contained in these terms and conditions shall not be valid or binding or of any force or effect. These terms and conditions are governed by California law and any disputes arising from them will be determined by the court with jurisdiction in San Diego county.
